Guarantee
We guarantee to deliver the purchases of our services, products, materials, and craftsmanship, as promised and specified in our verbal and written agreements.
Refund/Return Policy
Once you have chosen to accept one of our services/products, we are obligated to provide the service to you at the agreed price. If you choose to cancel the requested service before the service is delivered or completed, you must do so 24 hours prior to the scheduled start date of the service. A $25.00 cancellation administrative fee will be charged for any cancelled service. For one time purchases, or purchases that do not require deposits and/or progress payments, we do not offer a refund or return policy once the service has been delivered/completed.
Once you have chosen to accept one of our proposals, and signed the accompanied contract, you are entering a legal contract with Brushill Nursery and Landscape Services for the proposed work. We do not offer a refund or return policy for accepted proposals. Deposits and payments made to Brushill Nursery are non-refundable.
Warranty
Plant Material Warranty
Brushill Nursery and Landscaping offers a one-time replacement for plants that fail within ONE year of their planting, and a guarantee of a replacement within the growing season, using the same species and similar size. The warranty covers perennials, shrubs, evergreens and trees that have over 25% of their branch structure die, or lose a central leader (evergreen trees only). The guarantee covers all individual plants, except plants or projects that experience any of the following during the ONE year warranty period:
(A) Watering provision: the homeowner is responsible for regular watering during the first growing season. Plants installed in the months of March-May, must be watered a minimum of once per week, until the surrounding ground is completely saturated. Plants installed in the months of June-September, must be watered twice per week, until the surrounding ground is completely saturated. Plants installed in the months of October-December, must be watered a minimum of once per week, until the surrounding ground is completely saturated. We do not warranty plant material installed in January or February. Rain totals that are less than 1” per rainfall period, do not count towards watering the plant. Irrigation systems that do not have separate “shrub zones” or drip irrigation, do not count towards watering the plant.
(B) Damage or death of a plant caused by Vandalism, theft, or other circumstance beyond our control.
(C) Late Payment: all final payments are due UPON completion of work. Late payments for plant material will result in the termination of the warranty.
(D) We do not guarantee perennial plantings for a ONE year period unless 2 gal size container perennials or larger are used. The warranty does not cover 1 gal container perennials.
Interlocking Paver Warranty
(covers dry laid, natural stone and paver systems)
Warranty period begins from date of completed construction for a period of FIVE years. All material is guaranteed to be as specified. Warranty covers broken or cracked pavers that are damaged during installation. Warranty covers loose pavers, loose edge restraints, and settlement of pavers in excess of 3/8” compared to adjacent pavers, walls, or stair treads. The guarantee covers the entire interlocking paver system, except projects that experience any of the following during the FIVE year warranty period:
(A) Warranty does not cover naturally occurring efflorescence of pavers, stains, or any damage due to uncontrollable circumstances.
(B) Warranty is void if changes or alterations are made to the paver system. Warranty is void if new excavation, digging, or soil removal occurs within one foot of finished paver system.
(C) Warranty is void if high pressure water is used to clean the surface or joint lines of the pavers.
(D) Edge restraints in mulched planting beds can lift up during deep freezes; if requested we will reseat the affected edge restraints ONE time during the warranty period.
(E) Tree roots from existing trees can damage the interlocking paver system. We do not offer a warranty to protect the paver system from damage caused by existing tree roots.
(F) Late Payment: all final payments are due UPON completion of work. Late payments for paver projects will result in the termination of the warranty.
If a warranty claim is made, it must be submitted within the FIVE year warranty period. Requested repairs are made by Brushill Nursery and Landscaping, or one of our approved sub-contractors, and the costs for the repairs are covered by us. If you wish to have another company complete the repairs, we do not compensate you or others for the repair, and the warranty is void.
Retaining Walls, Seat Walls, Raised Patio Walls Warranty
Warranty period begins from date of completed construction for a period of FIVE years. All material is guaranteed to be as specified. Warranty covers broken or cracked wall units that are damaged during installation. Warranty covers loose wall stones, wall capstones, pier or pillar capstones, and stair treads. Warranty covers settlement of wall components in excess of 3/8” compared to adjacent wall components or walls that are leaning in excess of 3/8” compared to adjacent wall components. The guarantee covers the entire wall system, except projects that experience any of the following during the FIVE year warranty period:
(A) Warranty does not cover naturally occurring efflorescence of wall components, stains, or any damage due to uncontrollable circumstances.
(B) Warranty is void if changes or alterations are made to the wall system. Warranty is void if new excavation, digging, or soil removal occurs within one foot of finished wall system.
(C) Warranty is void if high pressure water is used to clean the surface or joint lines of the walls.
(D) Tree roots from existing trees can damage the wall system. We do not offer a warranty to protect the paver system from damage caused by existing tree roots.
